Scope
Cultural Heritage Collections are organized in various sections of the IR but typically found under three top communities: Cultural Heritage Collections, University Archives and Rice History, and Publications and Performances. These collections are generally curated or managed by Fondren Library and in particular by the Woodson Research Center for special collection materials. The following guidelines should apply to Cultural Heritage materials published in the Rice Digital Scholarship Archive.
However, there are some exceptions. Excluded are those collections that have pre-existing creator rights or agreements with parties outside the library. These include Shepherd School of Music (all rights reserved) and the KTRU Rice Radio archive (in partnership with KTRU student radio). Also excluded are collections managed or authored by faculty or students. For example: journals or periodicals produced by the Rice Community, such as The Samaritan Review, Archiving the Future: The Recovery of a Heritage in the Making's Project, and the Rice Historical Review undergraduate journal.
Background
Changing perspectives in the digital library community regarding use of creative common licenses inspired a review of local practices in applying rights metadata including a recent ACRL article outlining some specific use cases (†). In the past, Fondren’s “rights standardization efforts”, have commonly used creative common licenses to encourage attribution and communication of rights. Current thinking has evolved to determine that it is “legally inappropriate for people or organizations other than a rightsholder to try to apply an open license to a work.” This primarily impacts public domain and orphan works materials. In 2018, the library updated rights statements across all Cultural Heritage Collections to remove creative common licenses from public domain and orphan works materials. In addition to revised rights statements, we also added a local rights-type vocabulary and provide a statement regarding permission to publish that uses more “natural” or clear language. One benefit of this statement is it gives a potential user a contact/form if they have additional questions.
